Rep. Gabrielle Giffords’ bill to crack down on cross-border drug smuggling will get a vote in the House on Wednesday, possibly the Arizona Democrat’s final day in Congress.

The legislation was introduced last year and will be voted on under suspension of the rules before Giffords officially ends her Congressional career this week. The three-term lawmaker announced Sunday that she was stepping down from her seat in order to continue her recovery from being shot during a constituent event last January.

She is expected to attend tonight’s State of the Union address and be on the House floor Wednesday for consideration of her bill. During his weekly briefing with reporters today, House Minority Whip Steny Hoyer (D-Md.) predicted that Giffords would issue her letter of resignation shortly after her bill clears the floor.

“I’m not sure what the effective date of the resignation is, but I will expect the letter to be submitted,” Hoyer said.

Giffords’ legislation would penalize criminals who use small, low-flying aircraft to transport illegal drugs into the United States.
