Court of Appeals for the District of Columbia Circuit set a fast-tracked schedule to consider a request filed Monday night to pause that lower court ruling against the so-called Title 42 policy.
The high court agreed to take up the case on a faster schedule, hearing oral arguments in April, just a few months after the government asked for review.
Court of Appeals for the 5th Circuit backed Kacsmaryk’s decision, and the Supreme Court took up the case on a fast-tracked schedule. A decision is expected by the end of the term at the end of June.
The lawsuit was already on schedule for an initial decision on a separate request to stop the rescission of Title 42 before May 23.
